Tempur-Pedic®

20 Year Limited Warranty: Swedish Sleep System

Tempur Production USA, LLC (“Tempur-Pedic”) guarantees that we will, at Tempur-Pedic’s option, replace or repair purchaser’s Tempur-Pedic® mattress if it is defective due to faulty workmanship or materials, subject to the limitations described in this warranty.

This limited warranty does not include a normal increase in softness of the TEMPUR® pressure-relieving material which does not affect the pressure-relieving qualities of the mattress.

This warranty covers:

deterioration causing the mattress to have a visible indentation greater than three-fourths (0.75) of an inch that is not associated with a sag in the foundation or adjustable bed base; and
any physical flaw in the mattress that causes the TEMPUR material to split or crack, despite normal usage and proper handling (as outlined in the Mattress Use & Care Instructions).
Year 1 through 10 – Full Coverage
During the first ten (10) years of this warranty, Tempur-Pedic will not charge purchaser to repair or replace purchaser’s mattress if it is deemed defective, but any transportation costs associated with repairs or replacements are purchaser’s responsibility.

Year 11 through 20 – Prorated Coverage
During years 11 through 20 of this warranty Tempur-Pedic will, at its option, repair the mattress at a handling cost to purchaser, or replace the mattress at a prorated charge to purchaser plus transportation costs. If Tempur-Pedic replaces the mattress, the prorated replacement charge purchaser pays will depend on when the mattress is replaced.

*If the mattress is replaced during the eleventh year of this warranty, the prorated replacement charge purchaser pays will be fifty (50) percent of the original purchase price.

If the mattress is replaced after the eleventh year but before this warranty expires, the prorated charge purchaser pays will increase by five (5) percent for each subsequent year of the prorated period (i.e., 55% of the original purchase price if replaced during year twelve; 60% of the original purchase price if replaced during year thirteen, etc.)
Tempur-Pedic® mattresses are designed to work on a firm, solid-surface, non-spring foundation or adjustable bed base that is structurally capable of supporting the weight of purchaser’s Tempur-Pedic mattress. This warranty and other performance guarantees are based on tests conducted on “sets” that consist of our mattresses and foundations like these. THEREFORE, IF PURCHASER USES INAPPROPRIATE FOUNDATIONS, BOX SPRINGS, OR ADJUSTABLE BED BASES WITH THIS MATTRESS, SUCH USE WILL VOID THIS WARRANTY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Tempur-Pedic may require purchaser to provide proof of the quality of the foundation for the mattress if purchaser makes a claim under this warranty.

The Consumer Product Safety Commission has created the Standard for the Flammability (Open Flame) of Mattress Sets in Federal Register 16 CFR Part 1633. The foundation used with purchaser’s mattress, unless specified for use as the particular foundation for the mattress purchased, should not be construed as 16 CFR Part 1633 compliant.

If applicable, the cover for the mattress is warranted for two (2) years from the date of purchase against faults in material or workmanship. If Tempur-Pedic replaces the cover for the mattress, Tempur-Pedic will replace it with the current style of cover available for the mattress, which may be a different color or material than the original cover.

If the mattress, foundation, or cover is physically abused, damaged, burned, cut or torn, this warranty is void.

This warranty is valid only for the original purchaser of the product. An original purchaser is one who purchases the product directly from Tempur-Pedic or an authorized retailer of Tempur-Pedic. If purchaser is not the original purchaser of this product, he/she takes it “as is” and “with all faults.” If the purchase of this mattress was not directly from Tempur-Pedic, proof of purchase will be required to demonstrate that purchaser is the original purchaser and eligible to make a valid claim under this warranty.

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to Tempur-Pedic at the time of replacement.

This warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state.

PLEASE RETAIN THIS WARRANTY AND ORIGINAL PROOF OF PURCHASE FOR AT LEAST 20 YEARS FROM YOUR DATE OF PURCHASE.
 

20 Year Limited Warranty: Adjustable Swedish Sleep System

Leggett & Platt, Incorporated (L&P) warrants this Tempur-Pedic adjustable bed to the consumer who is the original purchaser (the “purchaser”), subject to the terms and conditions set forth herein. This warranty begins on the "warranty commencement date" which is the date of purchase for new unused beds and the date of manufacture for beds that have been used as floor or display models. Thus, on a floor model bed, the warranty is a portion of the limited 20-year warranty.

Full 1 Year Warranty

This Tempur-Pedic adjustable bed is warranted against defects in the workmanship or materials for a period of one year from the warranty commencement date. Upon notice during the first year after the warranty commencement date, L&P will repair or replace (at no cost to the purchaser) any defective Tempur-Pedic adjustable bed part, and L&P will pay all authorized labor and transportation costs associated with the repair or replacement of any parts found to be defective.

2-Year Limited Warranty

During the second year from the warranty commencement date, upon receipt of notice, L&P will replace any Tempur-Pedic adjustable bed part found to be defective. This limited two year warranty shall not apply unless the defective part is returned to L&P within ten (10) days of purchaser’s receipt of the replacement part. Purchaser shall pay all service and transportation costs related to the replacement of the defective part.

20-Year LImited Warranty

Upon notice during the third through the twentieth years from the warranty commencement date, L&P will replace, upon terms and conditions set forth in this paragraph, any Tempur-Pedic adjustable bed part found to be defective. Electronics, electrical components, drive motors and massage motors are excluded. Purchaser shall pay 1/18 of the then current replacement cost of the defective part multiplied by the number of years after two (2) years from the warranty commencement date, and L&P shall bear the remainder of the cost of the replacement part. This twenty (20) year warranty shall not apply unless the defective part is returned to L&P within ten (10) days of purchaser’s receipt of the replacement part. Purchaser shall pay all service and transportation costs related to the replacement of the defective part. After the twentieth year, purchaser shall bear the entire cost of repair and replacement of all parts and materials, including labor and transportation.

Additional Terms and Conditions

This warranty does not apply; (a) to any damage caused by the purchaser; (b) if there has been any repair or replacement of Tempur-Pedic adjustable bed parts by an unauthorized person; (c) if the Tempur-Pedic adjustable bed has been mishandled (whether in transit or by other means), subjected to physical or electrical abuse or misuse, or otherwise operated in any manner inconsistent with the operation and maintenance procedures outlined in the Owners Manual and this warranty; (d) to damage to mattresses, fabric, cables, electrical cords or items supplied by dealers.  Contact the dealer for warranty information on these items; (e) if there has been any modification of the Tempur-Pedic adjustable bed without prior written consent by L&P; (f) to costs for unnecessary service calls, including costs for in-home service calls solely for the purpose of educating the consumer about the Tempur-Pedic adjustable bed or finding an unsatisfactory power connection; (g) if the recommended weight restrictions are not followed (300-Twin; 375-Full; 425-Queen), the warranty will be void.

Repairs to or replacement of an adjustable bed or its components under the terms of this limited warranty will apply to the original warranty period and will not serve to extend such period.

The decision to repair or to replace defective parts under this warranty shall be made, or cause to be made, by L&P at its option and in its sole discretion.

Repair or replacement shall be the sole remedy of the purchaser. There shall be no liability on the part of L&P for any special, indirect, incidental, or consequential damages or for any other damage, claim, or loss not expressly covered by the terms of this warranty.

This limited warranty does not include reimbursement for inconvenience, removal, installation, setup time, loss of use, shipping, or any other costs or expenses. Leggett & Platt or its service technicians shall not be responsible for moving furniture, removing headboards & footboards or any other items in order to perform service on your adjustable bed.  It is the sole responsibility of the purchaser to provide adequate space and accessibility to the adjustable bed. In the event that the technician is unable to perform service due to lack of accessibility, the service call will be billed to the purchaser and the service will have to be rescheduled.

L&P makes no other warranty whatever, express or implied, and all implied warranties of merchantability and fitness for a particular purpose are disclaimed by L&P and excluded from this agreement.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to every purchaser.  This warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state. This warranty is valid in all 50 states, Puerto Rico, and Canada.

20 year limited warranty Tempur-pedic advanced ergo system

20 Year Limited Warranty: TEMPUR® Advanced Ergo System™
TEMPUR-PEDIC® warrants this TEMPUR® Advanced Ergo System™ to the consumer who is the original purchaser (the "purchaser," subject to the terms and conditions set forth herein). This warranty begins on the "warranty commencement date" which is the date of purchase for new unused units, and the date of manufacture for units that have been used as floor or display models. Thus, on a floor model unit, the warranty is a portion of the limited 20-year warranty. If original proof of purchase is not provided by purchaser, TEMPUR-PEDIC® reserves the right to determine the unit is not covered by this warranty or to use the manufacturing date as the warranty commencement date.


FULL 1-YEAR WARRANTY

TEMPUR-PEDIC® warrants this TEMPUR® Advanced Ergo System™ is warranted against defects in the workmanship or materials for a period of one (1) year from the warranty commencement date. Upon notice during the first year from the warranty commencement date, TEMPUR-PEDIC® will send replacement parts (at no cost to the purchaser) for any defective part to the purchaser, and TEMPUR-PEDIC® will pay all authorized labor and transportation costs associated with the repair or replacement of any parts TEMPUR-PEDIC® determines to be defective. This one (1) year warranty shall not apply if purchaser does not return any and all defective parts to TEMPUR-PEDIC® within 15 days of purchaser’s receipt of replacement part.


TWO-YEAR LIMITED WARRANTY

Upon notice during the years 2-3 from the warranty commencement date, TEMPUR-PEDIC® will offer replacement parts for any defective part to the purchaser. This two (2) year warranty shall not apply if purchaser does not return any and all defective parts to TEMPUR-PEDIC® within 15 days of purchaser’s receipt of replacement part. Purchaser shall bear all service, transportation, labor, and shipping costs related to the delivery and/or replacement of the defective part.


17-YEAR LIMITED WARRANTY

Upon notice during the 4 through the 20 years from the warranty commencement date, TEMPUR-PEDIC® will offer replacement parts (upon terms and conditions set forth in this paragraph) for any mechanical bed part found to be defective. Electronics, electrical components, drive motors and massage motors are excluded. Purchaser shall pay 1/17th of the then current replacement cost of the defective part multiplied by the number of years after three (3) years from the warranty commencement date, and Reseller shall bear the remainder of the cost of the replacement part. This seventeen (17) year warranty shall not apply if purchaser does not return any and all defective parts to Tempur-Pedic within 15 days of purchaser’s receipt of replacement part. Purchaser shall bear all service, transportation, labor, and shipping costs related to the delivery and/or replacement of the defective part. After the 20th year, purchaser shall bear the entire cost of repair and replacement of all parts and materials, including labor and transportation.


Additional Terms and Conditions

This warranty does not apply; (a) to any damage caused by the purchaser; (b) if there has been any unauthorized repair or replacement of the unit’s parts; (c) if the unit has been mishandled (whether in transit or by other means), subjected to physical or electrical abuse or misuse, or otherwise operated in any way inconsistent with the operation and maintenance procedures outlined in the Complete Reference Guide, this warranty, and any other applicable document published or approved by Tempur-Pedic; (d) to damage to mattresses, fabric, cables, electrical cords or items supplied by Resellers. Contact the Reseller or relevant party for warranty information on these items.; (e) if there has been any unnecessary service calls, including costs for in-home service calls solely for the purpose of educating the consumer about the unit for finding an unsatisfactory power connection; (g) if the recommended weight restrictions are not followed (Twin, Twin Long, Split/Dual Queen, Split/Dual CA King – 300 lbs.; Double, Double Long – 375 lbs.; Queen – 425 lbs.), the warranty will be void. Repairs to or replacement of the TEMPUR Advanced Ergo System or its components under the terms of this limited warranty will apply to the original warranty period and will not serve to extend such period. The decision to repair or to replace defective parts under this warranty shall be made, or case to be made, by Tempur-Pedic at its option and in its sole discretion.

REPAIR OR REPLACEMENT SHALL BE THE SOLE REMEDY OF THE PURCHASER. THERE SHALL BE NO LIABILITY ON THE PART OF TEMPUR-PEDIC FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR FOR ANY OTHER DAMAGE, CLAIM, OR LOSS NOT EXPRESSLY COVERED BY THE TERMS OF THIS WARRANTY. THIS LIMITED WARRANTY DOES NOT INCLUDE REIMBURSEMENT FOR INCONVENIENCE, REMOVAL, INSTALLATION, SETUP TIME, LOSS OF US, SHIPPING, OR ANY OTHER COSTS OR EXPENSES. TEMPUR-PEDIC MAKES NO OTHER WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED BY TEMPUR-PEDIC AND EXCLUDED FROM THIS AGREEMENT. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to every purchaser. This warranty gives the purchaser specific legal rights, and the purchaser may also have other rights, which may vary from state to state. If you are not the original purchaser of this product, you take it “as is” and “with all faults.” If you did not purchase this TEMPUR Advanced Ergo System directly from Tempur-Pedic North America, Inc., we will require proof of purchase from you demonstrating that you are the original purchaser and eligible to make a valid claim under this warranty. This warranty begins on the “warranty commencement date” which is the date of purchase for new unused units, and the date of manufacture for units that have been used as floor or display models. Thus, on a floor model unit, the warranty is a portion of the limited 20-year warranty. If original proof of purchase is not provided by purchaser, Tempur-Pedic reserves the right to determine if the unit is not covered by this warranty or to use the manufacturing date as the warranty commencement date.
